Mini Marketa – Terms & Conditions

These Terms & Conditions (“Terms”) apply to your use of Mini Marketa (“we”, “us”, “our”), including browsing, buying, selling, and submitting items for listing on our website.
By accessing or using Mini Marketa, you agree to these Terms.
1. About Mini Marketa
Mini Marketa is a curated Australian marketplace for buying and selling pre-loved children’s toys, games, and family puzzles. We focus on trust, quality, convenience, and sustainability by reviewing listings, handling payments, and supporting buyers and sellers throughout the transaction.
Mini Marketa operates Australia-wide only.
2. Curated Listings & Quality Standards
2.1 Listing review
All items submitted to Mini Marketa are reviewed before being approved and published. We may accept or decline a submission at our discretion, including where an item does not meet our quality, safety, or presentation standards.
We may request additional information or photos before approving a listing.
2.2 Seller responsibilities
By submitting an item for sale, the seller confirms that:
- the item is clean, safe, and suitable for use
- the condition is accurately described, including any wear, faults, or missing parts
- the item is complete as described
- the item is not subject to any known recall
- the item is genuine and legally able to be sold
Misrepresentation may result in listing removal, refunds, or account suspension.
2.3 Prohibited items
Items that are unsafe, recalled, illegal, counterfeit, or inappropriate may not be listed. Mini Marketa reserves the right to remove any listing that breaches these Terms or compromises buyer trust.
3. Pricing, Postage & Fees
3.1 Item pricing
Sellers set their own item price. Pricing guidance may be provided by Mini Marketa but is optional.
3.2 Flat-fee postage
If shipping is offered, sellers must provide a single flat postage fee. The buyer sees one total price at checkout that includes:
- item price, plus
- flat postage fee
Sellers are responsible for ensuring the postage fee is sufficient. Any additional postage costs are the seller’s responsibility.
3.3 Mini Marketa service fee
Mini Marketa charges a 10% service fee on the item price only.
Postage fees are not included in the service fee.
This fee covers listing review, secure payments, customer support, and dispute handling.
4. Orders & Delivery
4.1 Shipping orders
For shipped orders:
- sellers must dispatch items within five (5) business days of order confirmation
- items must be packaged appropriately to avoid damage in transit
- tracking is strongly recommended and may be requested
4.2 Pickup orders
For pickup orders:
- payment is completed through Mini Marketa (no cash payments)
- buyer and seller arrange pickup after purchase
- pickup must be completed within five (5) days of purchase unless otherwise agreed
5. Payment Handling & Release
5.1 Payment processing
All payments are processed through Mini Marketa. Buyers do not pay sellers directly.
5.2 Payment release — shipping
For shipped orders, payment is released to the seller once:
- delivery is confirmed, and
- no issue has been reported within three (3) days of delivery.
Where delivery confirmation is unavailable, payment may be released after a reasonable delivery period at Mini Marketa’s discretion, provided no dispute has been raised.
5.3 Payment release — pickup
For pickup orders, payment is released once the buyer confirms pickup.
If confirmation is not received, payment may be released after five (5) days, provided no dispute has been raised.
5.4 Seller payment details
Once an order is successfully completed, Mini Marketa will contact the seller to collect bank account details for payment.
6. Cancellations, Refunds & Issues
6.1 Seller non-delivery
If a seller does not dispatch an item within the required timeframe or fails to complete a pickup arrangement, Mini Marketa may cancel the order and provide the buyer with a full refund.
6.2 Issues with an order
If an item arrives damaged or significantly not as described, the buyer must contact Mini Marketa within three (3) days of delivery with supporting information (such as photos).
Mini Marketa will assess the issue and determine an appropriate resolution, which may include a refund or return.
6.3 Change of mind
Because Mini Marketa sells pre-loved items from individual sellers, change-of-mind returns are generally not accepted, except where required under Australian Consumer Law.
7. Platform Rules & User Conduct
7.1 Honest use
Users must provide accurate information and must not misrepresent items, condition, or availability.
7.2 Off-platform transactions
Users must not attempt to complete transactions or payments outside Mini Marketa. This helps protect both buyers and sellers.
7.3 Account action
Mini Marketa may suspend accounts or remove listings that breach these Terms, undermine trust, or result in repeated disputes.
8. Content & Permissions
By submitting photos or descriptions, you confirm you own the content or have permission to use it. You grant Mini Marketa a non-exclusive right to display and use this content to operate and promote the marketplace while the listing is active and for reasonable promotional purposes.
9. Role of Mini Marketa & Liability
Mini Marketa provides the platform, listing review, payment handling, and transaction support. Items are sold by individual sellers.
To the extent permitted by law, Mini Marketa is not liable for indirect or consequential losses arising from use of the platform.
Nothing in these Terms excludes or limits any rights you have under Australian Consumer Law.
10. Privacy
We collect only the information necessary to operate Mini Marketa and complete transactions. Personal information may be shared with relevant parties (such as the other user in a transaction or service providers) solely for operational purposes.
11. Changes & Governing Law
Mini Marketa may update these Terms from time to time. Updated Terms apply from the date they are published on the website.
These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
